CLASSIFICATION, LABELING OF THE MIXTURE AND OBLIGATION OF TRADE OWNERSHIP
E-liquid with a nicotine concentration from 1.7% by weight (i.e. 17 mg nicotine/ml) to 2% by weight (i.e. 20 mg nicotine/ml), when 20 mg/ml is the maximum allowed concentration of nicotine in e-liquid, is classified as a dangerous chemical mixture according to Regulation (EC) No. 1272/2008 of the European Parliament and Council on the classification, labeling and packaging of substances and mixtures (CLP regulation) (i.e. it is a chemical mixture classified in Annex No. 2 to the Trade Act as "toxic"). The packaging of the mixture is marked with the warning symbol GHS06. The sale of a mixture classified in this way falls under the related trade "Manufacture of dangerous chemical substances and dangerous chemical mixtures and sale of chemical substances and chemical mixtures classified as highly toxic and toxic".
E-liquid containing nicotine in a concentration equal to or higher than 0.25% by weight and lower than 1.7% will be classified as a dangerous mixture according to the CLP regulation (i.e. it is not a chemical mixture classified in Annex No. 2 to the Trade Act as "toxic"). The packaging of the mixture is marked with the warning symbol GHS07. The sale of such a classified mixture falls under the free trade "Manufacturing, trade and services not listed in Annexes 1 to 3 of the Trade Act", field of activity 48 "Wholesale and retail trade".
Mixtures without nicotine content or with nicotine content up to 0.25% are not classified as dangerous according to the CLP regulation. The sale of such mixtures falls under the free trade "Manufacturing, trade and services not listed in Annexes 1 to 3 of the Trade Act", field of activity 48 "Wholesale and retail trade".
